Theft Waiver - Terms & Conditions
1. Nature of the Waiver
- The Theft Waiver is a discretionary contractual agreement between Zenion Limited and the customer. This agreement is an amendment to your rental terms and is not an insurance product, policy, or contract.
- It is an optional, paid service where Zenion Limited agrees to waive its contractual right to recover certain replacement or repair costs from the customer in the event of a verified vehicle theft.
- This contract applies only while a rental agreement is active and account payments are current.
2. Waiver Fee and Term
- The Theft Waiver fee is £5.00 per week per rental agreement.
- Protection starts when the customer opts in and begins paying the weekly fee. However, a strict 24-hour qualifying window applies from the exact time of activation; no waiver requests will be accepted for any theft occurring within the first 24 hours of the waiver period.
- This agreement automatically terminates when the main rental agreement ends, is paused, or if rental payments fall into arrears, subject to the Lock-in Period and Early Termination liabilities below.
- Lock-in Period Following an Incident: If a customer utilises the Theft Waiver and a waiver request is successfully approved, the customer is strictly prohibited from opting out of or cancelling the Theft Waiver for a minimum period of 52 weeks (12 months) from the date of the incident. The weekly £5.00 fee will continue to apply for the remainder of this 52-week period, provided the rental agreement remains active.
- Early Termination Liability: If, and only if, a customer has had a successful waiver request approved under this agreement, terminating their rental agreement or returning the vehicle before the conclusion of the 52-week lock-in period will make them fully liable for the remaining balance of the 52-week waiver term. The total outstanding balance (calculated at £5.00 per remaining week) will become immediately due and payable as a lump sum upon termination of the rental agreement. (If no waiver request has been made against this contract, no early termination liability applies).
- Automatic Reactivation: If a customer with an active 52-week lock-in period pauses their rental agreement (where permitted), the weekly waiver fee will pause. However, if that customer opens any new or subsequent rental agreement with Zenion Limited within that same 52-week window, the Theft Waiver "bolt-on" and its weekly £5.00 fee will be automatically reactivated on the new agreement for the remainder of the original 52-week term.
3. Eligibility and Security Conditions
To benefit from this liability reduction, customers must be at least 21 years of age and maintain up-to-date payments. Additionally, the customer must demonstrate a high standard of reasonable care in securing the vehicle. The waiver will be voided and will not be applied if:
- Keys or fobs were left in, on, or near the vehicle, or the vehicle was left running while unattended.
- Power packs/batteries were not removed from the vehicle during periods when it was left unused for an extended duration or parked overnight.
- The vehicle was not physically secured, or the mechanical steering lock was left unactivated.
4. Scope of Protection & Mandatory Excess
If a waiver request is approved, Zenion Limited will reduce the customer's financial liability for theft-related asset losses, subject to a mandatory excess fee:
- Mandatory Excess: Each approved theft incident is subject to a maximum excess fee of £150.
- If the total cost of repair or replacement is less than £150, the customer will only be charged the actual cost.
- If the total cost of repair or replacement exceeds £150, the customer’s liability is capped at £150 (subject to the liability caps below), and Zenion Limited will waive the remaining balance.
- This fee must be paid by the customer before a replacement vehicle is issued or repairs are initiated.
- Unrecovered Vehicle Theft Cap: If the vehicle is stolen and not recovered, the waiver provides a maximum liability reduction of up to £1,500 toward the vehicle's replacement value (minus the £150 excess). Any replacement costs exceeding this £1,500 threshold remain fully payable by the customer.
- Recovered Vehicle (Damaged) Cap: If the vehicle is recovered but found to be damaged, the waiver covers up to £800 toward those repair costs (minus the £150 excess). Any repair costs exceeding £800 remain fully payable by the customer.
- Absolute Exclusions: This waiver never applies to batteries, power packs, or charging accessories. These items remain the customer’s full, un-waivable financial responsibility regardless of the circumstances of the theft.
5. Incident Frequency & Lock-in Tracking
For the purposes of tracking waiver usage and financial commitments:
- This contractual protection is strictly limited to one approved theft waiver request per customer in any rolling 52-week period.
- Incident records, financial liabilities, and remaining lock-in terms remain permanently attributable to the customer across multiple, broken, or paused rental periods. Ending a rental agreement early does not absolve the customer of the remaining financial liability calculated in Section 2 if a waiver activation has occurred.
6. Incident Reporting Requirements & Legal Warnings
To request a liability reduction under this waiver, the customer must strictly adhere to the following timeline, cooperation, and honesty rules:
- Report Immediately: Notify Zenion Limited of the theft without delay and within a maximum of 24 hours of discovery.
- Police Record: Zenion Limited will formally report the theft to the Police to obtain an official Crime Reference Number (CRN). The customer must fully assist Zenion Limited in this process.
- Cooperate: Provide a signed written statement and all requested information regarding the timelines and security actions surrounding the incident.
- 🚨 Criminal Offence Warning: All statements, data, and details provided by the customer regarding the theft will be submitted directly to law enforcement as part of the official criminal investigation. Providing false, misleading, or incorrect information to Zenion Limited or the Police is a serious criminal offence (including fraud and wasting police time) and could result in criminal prosecution.
- Failure to comply with these reporting steps or the security conditions in Section 3 will result in the waiver request being declined.
7. Discretion and Assessment
- Zenion Limited retains sole and absolute discretion to determine whether the mandatory security conditions were met and whether the waiver shall be applied to the account.
- Zenion Limited reserves the right to cancel a customer’s Theft Waiver protection immediately and permanently, and report the individual to authorities, if fraudulent activity, false statements, intentional exposure to risk, or severe negligence is suspected.
8. Non-Transferable and Governing Law
- This waiver protection is personal to the designated customer and cannot be transferred to any other party or alternative agreement.
- Zenion Limited reserves the right to amend these terms at any time. These conditions are governed by the laws of England and Wales.
